Terms and Conditions of Sale and Use for Gift Sets \/ E-gift Sets and Gift Cards \/ E-gift Cards<\/strong><\/u><\/strong><\/h3>\n\n\n\n

PRAMBLE<\/h4>\n\n\n\n

For the purposes of the terms and conditions set forth herein, the following terms shall have the meanings set forth below:<\/p>\n\n\n\n

– Teritoria Voyages (TV):<\/strong> a legal entity offering services for sale under the Teritoria brand<\/p>\n\n\n\n

– Customer:<\/strong> a natural person or legal entity making a purchase from TV<\/p>\n\n\n\n

– Beneficiary:<\/strong> refers to the natural person or legal entity who receives and uses the service sold by TV<\/p>\n\n\n\n

– MyBeezBox:<\/strong> software enabling TV to market gift boxes and e-gift boxes. MyBeezBox does not act as a seller.<\/p>\n\n\n\n

– Gift box:<\/strong> a commercial offer allowing the customer to give a predefined service to the beneficiary of their choice, sold in physical format. <\/p>\n\n\n\n

– E-gift box:<\/strong> a commercial offer allowing the customer to give a predefined service to the recipient of their choice, sold in digital format. <\/p>\n\n\n\n

– Gift card:<\/strong> a commercial offer allowing the customer to give a predefined amount to the recipient of their choice, sold in physical format. <\/p>\n\n\n\n

– E-gift card:<\/strong> a commercial offer allowing the customer to give a predefined amount to the recipient of their choice, sold in digital format. <\/p>\n\n\n\n

– Voucher:<\/strong> refers to a purchase confirmation summarizing all the terms and conditions of use of the offer by the recipient, received via email in PDF format. <\/p>\n\n\n\n

– Company:<\/strong> The company that owns the Teritoria brand<\/p>\n\n\n\n

– The website:<\/strong> refers to the website selling the gift boxes \/ e-gift boxes marketed by TV: https:\/\/www.teritoria.com\/boutique-cadeaux\/<\/a><\/p>\n\n\n\n

<\/div>\n\n\n\n

These General Terms and Conditions of Sale (GTC) are entered into between:<\/p>\n\n\n\n

– On the one hand, <\/p>\n\n\n\n

TERITORIA VOYAGES, a simplified joint-stock company with a capital of \u20ac99,500, whose registered office is located at 83 avenue d\u2019Italie, 75013 Paris, registered with the Paris Trade and Companies Register under number 382 256 857; legally represented by Karim Soleilhavoup, duly authorized for these purposes.<\/p>\n\n\n\n

– And on the other hand, the customer,<\/p>\n\n\n\n

TERITORIA VOYAGES uses the MyBeezBox solution to offer gift boxes\/e-gift boxes sold online and available via the websites mentioned in the preamble.<\/p>\n\n\n\n

In this case, MyBeezBox is the provider of the IT solution; TV is solely responsible for the sale. <\/p>\n\n\n\n

<\/div>\n\n\n\n

By proceeding with the purchase, you certify that you have read these General Terms and Conditions of Sale and Use and accept them without reservation. <\/p>\n\n\n\n

<\/div>\n\n\n\n

ARTICLE 1: GENERAL PROVISIONS<\/h4>\n\n\n\n
<\/div>\n\n\n\n

These terms and conditions apply to the online sale of gift boxes\/e-gift boxes and gift cards\/e-gift cards by TV, as well as to their use. TV reserves the right to modify these terms and conditions; however, any such modification shall not apply to contracts entered into prior to such modification, which shall continue to be governed by the terms and conditions applicable to those sales.<\/p>\n\n\n\n

ARTICLE 2: SERVICES OFFERED AND ONLINE CONTRACTS<\/h4>\n\n\n\n
<\/div>\n\n\n\n
Section 2.1<\/h5>\n\n\n\n

Gift boxes \/ e-gift boxes and gift cards \/ e-gift cards are available on the website mentioned in the preamble, where the seller is TV. <\/p>\n\n\n\n

Gift boxes and e-gift boxes take the form of specific services detailed on the website and on the gift certificate received by mail or the e-gift certificate received by email. <\/p>\n\n\n\n

Gift cards and e-gift cards take the form of a specific amount detailed on the website and on the gift card voucher received by mail or the e-gift card received by email. <\/p>\n\n\n\n

The photos and videos describing the services included in the various gift boxes, e-gift boxes, gift cards, and e-gift cards are not contractually binding.<\/p>\n\n\n\n

Section 2.2<\/h5>\n\n\n\n

Gift boxes\/e-gift boxes and gift cards\/e-gift cards are available for purchase online on the website mentioned in the preamble. <\/p>\n\n\n\n

For TV to process this purchase, full payment for the service must be received.<\/p>\n\n\n\n

When purchasing online, the customer is redirected to a secure platform managed by MyBeezBox and its banking partner HomelocPay, the latter being a partner of Mangopay Advent International.<\/p>\n\n\n\n

The purchase of the gift box \/ e-gift box or gift card \/ e-gift card is made by the customer, who is not necessarily the recipient. If the customer is not the recipient of the offer, the recipient will be automatically notified of this purchase via email.<\/p>\n\n\n\n

At the time of payment, TV certifies that it provides the customer with a link to access these Terms and Conditions. <\/p>\n\n\n\n

ARTICLE 3 : PRICE<\/h4>\n\n\n\n
<\/div>\n\n\n\n

The prices listed on the websites mentioned in the introduction are inclusive of all taxes, excluding the tourist tax, which will be charged on site. <\/p>\n\n\n\n

No claims regarding services not included in the offer will be accepted.<\/p>\n\n\n\n

TV reserves the right to modify prices, without retroactive application to sales concluded prior to such modification.<\/p>\n\n\n\n

ARTICLE 4: TERMS OF USE  <\/h4>\n\n\n\n

Section 4.1: List of Participating Establishments <\/h5>\n\n\n\n

TV offers gift certificates and e-gift certificates that can be redeemed at select Teritoria establishments and viewed via the link provided on the voucher; it is the recipient\u2019s responsibility to choose from this list the establishment where they wish to redeem their gift certificate or e-gift certificate.  <\/p>\n\n\n\n

TV offers gift cards and e-gift cards that can be used at all Teritoria establishments and viewed via the link provided on the voucher; it is the recipient\u2019s responsibility to choose the establishment where they wish to use their gift card or e-gift card. <\/p>\n\n\n\n

Section 4.2: Validity <\/h5>\n\n\n\n

Both gift boxes\/e-gift boxes and gift cards\/e-gift cards are valid for a period of 24 months. The validity period begins on the date of purchase. The validity period of gift boxes\/e-gift boxes and gift cards\/e-gift cards is indicated in the product description on the website and also on the voucher received by the recipient.<\/p>\n\n\n\n

<\/div>\n\n\n\n

The gift box \/ e-gift box must be used in a single transaction. The e-gift box is the sole responsibility of the holder, particularly in the event of loss or theft.<\/p>\n\n\n\n

<\/div>\n\n\n\n

If not used within the validity period, the gift box \/ e-gift box or gift card \/ e-gift card may be extended once, but cannot be replaced or refunded.<\/p>\n\n\n\n

The extension request must be made within the month preceding the expiration date and no later than one (1) month after the actual expiration date. All extension requests must be sent by email to aide@teritoria.com, specifying the reference number of the gift box \/ e-gift box or gift card \/ e-gift card. The extension is subject to a fee of \u20ac40 per gift box \/ e-gift box \/ gift card \/ e-gift card via a secure payment link provided by customer service. The extension period is a maximum of 6 months from the original expiration date.<\/p>\n\n\n\n

TV cannot be held responsible if an establishment included in the gift box or e-gift box at the time of purchase is no longer available at the time of booking the service. <\/p>\n\n\n\n

<\/div>\n\n\n\n
Section 4.3: Booking with the establishment <\/h5>\n\n\n\n

A reservation must be made after purchase in order to use the gift box or e-gift box. TV is in no way responsible for booking the services. <\/p>\n\n\n\n

<\/div>\n\n\n\n

The reservation must be made directly with the establishment during the offer\u2019s validity period indicated on the voucher. The date of service provision cannot fall outside this validity period.<\/p>\n\n\n\n

The list of establishments participating in a gift box\/e-gift box can be viewed via a link provided on the voucher and also on the website in the \u201cUse your gift box or card\u201d section.<\/p>\n\n\n\n

<\/div>\n\n\n\n

The recipient must provide the establishment with their gift box\/e-gift box number to confirm their reservation.  If any of the services included in the gift box are unavailable, the establishment may substitute them with an equivalent service. <\/p>\n\n\n\n

<\/div>\n\n\n\n

The booking and cancellation policies are those of the establishment where the recipient chooses to redeem their gift certificate or e-gift certificate. At the time of booking, the recipient will be informed by the establishment of the booking and cancellation policies in effect for the selected period. Gift boxes\/e-gift boxes can be booked year-round, except on the following dates: January 1, February 14, December 24, 25, and 31, and dates corresponding to specific local events. The establishment reserves the right to set the dates of availability for services.<\/p>\n\n\n\n

<\/div>\n\n\n\n

The Establishment may refuse a reservation when the stock and availability specifically allocated to gift boxes\/e-gift boxes for the period is exhausted, even if it has overall availability. <\/p>\n\n\n\n

In the event that the Beneficiary has multiple Gift Boxes, the Establishment is free to accept or decline a reservation for multiple rooms or consecutive nights using multiple Gift Boxes.<\/p>\n\n\n\n

<\/div>\n\n\n\n

The gift box\/e-gift box is considered used as of the date of reservation with the establishment, unless specific cancellation terms are provided by said establishment.<\/p>\n\n\n\n

<\/div>\n\n\n\n

When paying with a gift card or e-gift card, we strongly recommend that you inform the establishment in advance of your visit that you wish to pay all or part of the bill with a gift card or e-gift card, as this will make check-in easier on the day of your visit.<\/p>\n\n\n\n

<\/div>\n\n\n\n
Section 4.4: ETIK Loyalty Program<\/strong><\/h5>\n\n\n\n

The value of the gift box\/e-gift box or gift card\/e-gift card is not eligible for the ETIK loyalty program, either at the time of purchase or when the service is provided at an establishment, with the exception of any additional services that may be paid for directly to the establishment. <\/p>\n\n\n\n

<\/div>\n\n\n\n

ARTICLE 5: DELIVERY OPTIONS FOR THE GIFT SET OR GIFT CARD<\/h4>\n\n\n\n
<\/div>\n\n\n\n

The customer may choose from several delivery options for their purchase. A confirmation of the purchase of the gift set or gift card will be sent as soon as payment is processed.<\/p>\n\n\n\n

<\/div>\n\n\n\n

First, if the customer is the recipient of the offer:<\/p>\n\n\n\n

– The purchase confirmation for the offer is sent to the customer via email. The voucher will be accessible via a hyperlink in that email until the physical package is received. The customer can then download the voucher in PDF format by clicking on the link. They will then be able to print it if necessary.<\/p>\n\n\n\n

On the other hand, if the customer is not the recipient of the offer:<\/p>\n\n\n\n

– Send the customer a purchase confirmation for the offer via email. The gift certificate will be accessible via this email using a hyperlink, pending the recipient\u2019s receipt of the physical package. The customer can then download the gift certificate in PDF format by clicking on the link. They will then be able to print it if necessary.<\/p>\n\n\n\n

– Send the recipient an email informing them that a gift box has been purchased for them. Since the email address was provided by the purchaser, the voucher will be accessible via that email using a hyperlink. The recipient can then download the voucher in PDF format by clicking on the link. They will then be able to print it if necessary.   <\/p>\n\n\n\n

<\/div>\n\n\n\n

If the customer or recipient encounters any difficulties receiving the voucher, please contact TV with any complaints. See Article 7 for details regarding complaints.<\/p>\n\n\n\n

<\/div>\n\n\n\n

If the customer makes an error that prevents or delays receipt of the voucher, TV cannot be held liable. Complaints will then be handled on a case-by-case basis.<\/p>\n\n\n\n

<\/div>\n\n\n\n
Processing of Gift Box and Gift Card Orders<\/u><\/h5>\n\n\n\n

Orders for gift boxes and gift cards are processed within 48 business hours of the order being confirmed via email sent to the Customer.<\/p>\n\n\n\n

Gift boxes and gift cards are sent by mail, according to the delivery method selected by the Customer at the time of ordering (Lettre Suivie or Chronopost), to the person and delivery address whose details were expressly provided by the Customer at the time of ordering.<\/p>\n\n\n\n

<\/div>\n\n\n\n

TERITORIA VOYAGES will send the Customer, through its logistics subcontractor, an email notifying them of the shipment of the ordered gift boxes and gift cards, specifying the tracking number of the carrier selected by the Customer as part of their order.<\/p>\n\n\n\n

<\/div>\n\n\n\n

Delivery times provided by TERITORIA VOYAGES\u2019 service providers are for informational purposes only, as follows:<\/p>\n\n\n\n

– Tracked Mail Delivery: Delivery time of approximately 2 to 3 business days from the date of shipment (for mainland France). For deliveries outside mainland France, delivery times vary by destination.<\/p>\n\n\n\n

– Chronopost Delivery: Delivery time of 1 to 2 business days (24\u201348 hours) from the date of shipment (for mainland France). For deliveries outside mainland France, delivery times vary depending on the destination. No deliveries are made on Saturdays.<\/p>\n\n\n\n

<\/div>\n\n\n\n

Shipments are made as described below.<\/p>\n\n\n\n

<\/div>\n\n\n\n

Monday through Thursday (excluding holidays):<\/strong><\/p>\n\n\n\n

\u2013 Orders placed before 10 a.m.: shipped the same day<\/p>\n\n\n\n

\u2013 Orders placed after 10 a.m.: shipped the next day<\/p>\n\n\n\n

Friday (excluding holidays):<\/strong><\/p>\n\n\n\n

\u2013 Orders placed before 10 a.m.: shipped the same day<\/p>\n\n\n\n

\u2013 Orders placed after 10 a.m.: shipped the following Monday <\/p>\n\n\n\n

<\/div>\n\n\n\n

Any order placed on a Saturday or Sunday will automatically be considered as having been placed on Monday before 10 a.m. Any order placed on a holiday will be processed the following business day (excluding weekends).<\/p>\n\n\n\n

    The Customer is solely responsible for the accuracy of the information provided when placing the order, including the recipient\u2019s contact information and the delivery address for the Physical Gift Sets and Physical Gift Cards ordered. TERITORIA VOYAGES shall in no event be held liable for a returned shipment due to an incomplete or incorrect address, and the costs of reshipment shall be borne entirely by the Customer. In the event that the recipient is absent and a delivery notice is left, TERITORIA VOYAGES shall in no event be held liable for any damage to the Gift Sets and Gift Cards resulting from their late collection. Exceeding delivery deadlines shall in no event give rise to claims for damages.<\/p>\n\n\n\n

    ARTICLE 6: DELIVERY OPTIONS FOR E-GIFT PACKAGES OR E-GIFT CARDS<\/h4>\n\n\n\n

    The customer may choose from several delivery options for their purchase. A confirmation of the purchase of the e-gift package or e-gift card is sent as soon as payment is processed.<\/p>\n\n\n\n

      • An email is sent to the recipient informing them of the purchase of an e-gift box on their behalf. Since the email address is provided by the purchaser, the gift certificate will be accessible via that email using a hyperlink. The recipient can then download the gift certificate in PDF format by clicking on the link. They may then print it if necessary.  <\/li>\n<\/ul>\n\n\n\n

        If the customer or recipient encounters any difficulties receiving the voucher, please contact TV with any complaints. See Article 8 for details regarding complaints.<\/p>\n\n\n\n

        If the customer makes an error that prevents or delays receipt of the voucher, TV cannot be held liable. Complaints will then be handled on a case-by-case basis.<\/p>\n\n\n\n

        ARTICLE 7: PAYMENT<\/h4>\n\n\n\n
        <\/div>\n\n\n\n

        E-gift boxes are available for purchase exclusively via payment by Visa, Mastercard, or Carte Bleue.<\/p>\n\n\n\n

        <\/div>\n\n\n\n

        Payment security is guaranteed by MangoPay, a subsidiary of Mangopay Advent International. Your banking information is entered only within this encrypted system.<\/p>\n\n\n\n

        <\/div>\n\n\n\n

        E-gift boxes cannot be paid for using a Logis Hotels e-gift card or an ETIK loyalty voucher. In the event of an error or payment refusal, the transaction is considered unsuccessful, and the purchase is then suspended.<\/p>\n\n\n\n

        <\/div>\n\n\n\n

        ARTICLE 8: CANCELLATION AND COMPLAINTS <\/h4>\n\n\n\n
        <\/div>\n\n\n\n

        In accordance with applicable legal provisions, the customer has 14 days from receipt of their e-gift box to exercise their right of cancellation. <\/p>\n\n\n\n

        <\/div>\n\n\n\n

        In the event of a withdrawal or a complaint regarding the purchase of an e-gift box or the receipt of the voucher, you may contact TV \u2013 Teritoria Voyages via:<\/p>\n\n\n\n

          In the event of an error in the delivery or content of the gift certificate, or if the gift certificate is damaged during shipping, you have 14 days from the date of receipt to notify TV.<\/p>\n\n\n\n

          In the event of loss or theft of your gift certificate, you must notify TV within 14 days of discovering the incident.<\/p>\n\n\n\n

          <\/div>\n\n\n\n

          If the e-gift box has been used to book a service prior to the expiration of the 14-day withdrawal period, such use shall be deemed immediate use and a waiver of the Customer\u2019s right of withdrawal. <\/p>\n\n\n\n

          <\/div>\n\n\n\n

          ARTICLE 9: WARRANTIES<\/h4>\n\n\n\n
          <\/div>\n\n\n\n

          As provided in Article L.211-4 of the French Consumer Code, the seller agrees to comply with the various contractual warranties set forth herein. TV certifies that it holds liability insurance appropriate to the activity it conducts.<\/p>\n\n\n\n

          This provision applies to the beneficiary, who must hold sufficient liability insurance in connection with the practice of a sporting activity, whether or not it is considered \u201chigh-risk.\u201d<\/p>\n\n\n\n

          <\/div>\n\n\n\n

          ARTICLE 10: AMENDMENTS AND VOIDITY OF THE CONTRACT<\/h4>\n\n\n\n
          <\/div>\n\n\n\n
          Article 10.1<\/h5>\n\n\n\n

          Any provision of the purchase agreement may be amended with the written consent of both parties.<\/p>\n\n\n\n

          <\/div>\n\n\n\n
          Article 10.2<\/h5>\n\n\n\n

          The fact that TV does not invoke one of the clauses of these general terms and conditions of sale does not constitute a waiver of its right to enforce that clause at a later date.<\/p>\n\n\n\n

          The invalidity of any provision of these general terms and conditions of sale shall not render the entire agreement invalid.<\/p>\n\n\n\n

          ARTICLE 11: INTELLECTUAL PROPERTY RIGHTS<\/h4>\n\n\n\n
          <\/div>\n\n\n\n

          TV sells its gift boxes\/e-gift boxes and gift cards\/e-gift cards on its websites; the content of these websites (photos, videos, etc.) is the property of TV and may not be reproduced without prior authorization.<\/p>\n\n\n\n

          If necessary, TV reserves the right to take legal action against the individual or entity responsible for such infringement.<\/p>\n\n\n\n

          ARTICLE 12: PROTECTION OF PERSONAL DATA<\/h4>\n\n\n\n

          When you use MyBeezBox<\/em><\/strong><\/p>\n\n\n\n

          When you visit websites that use the technology provided by the MyBeezBox solution or when you sign up for one of our services, we ask you to provide personal information about yourself.<\/p>\n\n\n\n

          We automatically collect information about your computer\u2019s hardware and software. This information may include your IP address, browser type, domain names, Internet service provider, files accessed on our site (HTML pages, graphics, etc.), operating system, clickstream data, and access times. This information is used by MyBeezBox to operate its services, maintain service quality, and provide general statistics regarding the use of our services. <\/p>\n\n\n\n

          When you make a transaction via MyBeezBox<\/em><\/strong><\/p>\n\n\n\n

          Your banking information, such as your credit card number and the CVV code, is transmitted securely via MangoPay, our PCI DSS-certified banking partner, to ensure the transaction is processed correctly.<\/p>\n\n\n\n

          <\/div>\n\n\n\n

          HOW WE USE THE INFORMATION WE COLLECT<\/strong><\/p>\n\n\n\n

          All customers who sign a contract with TV agree to comply with the terms of the contract as well as the provisions of the GDPR regarding the use, collection, and processing of personal data. No information is sold to third parties.<\/p>\n\n\n\n

          We use a third-party service provider named MangoPay to manage credit card processing. This service provider is not authorized to store, retain, or use the information you provide, except for the sole purpose of processing credit cards on our behalf. We use various security technologies and procedures to protect your personal information from unauthorized access, use, or disclosure. We secure the personal information you provide on computer servers in a controlled and secure environment, protected against unauthorized access, use, or disclosure. All personal information is protected using appropriate physical, technical, and organizational measures.<\/p>\n\n\n\n

          RETENTION PERIOD FOR PERSONAL DATA<\/strong><\/p>\n\n\n\n
